Presentation
What may be more relevant is how others have described me: contrarian, curmudgeon, beloved (that one really got to me), workaholic. I try to be generous of spirit, but I am often intolerant of incompetence, particularly my own. I have a propensity to speak my mind and piss people off as a result. My wife believes I do it for fun. I don't care what people think of me (outside of my family), but I do care what people think of my ideas.

Who Says You Can’t: Strategies and Tactics for Becoming a More Creative Criminal Defense Lawyer 2023
"Who Says You Can't...?" is about challenging rules, decisions, and even the assumptions and advice of more experienced lawyers who say you can't do something. Because with the right mindset, hard work, and creativity, you can. This is not a treatise on criminal practice. It is a first of its kind publication which demonstrates both the theory and practice of finding creative ways to go about solving seemingly intractable problems in the defense of an individual accused of a crime. This guide discusses how to become more creative, adopting a mindset that will help you to prevail in cases that look impossible to win; and how to help your client come out a winner even when you lose the case.
Justice Alito’s Opinion on Abortion: Not Just the End of Reproductive Rights, But the Downfall of Fundamental Civil Liberties Guaranteed by the Fourth Amendment to All Americans 2022
After Justice Samuel Alito’s draft opinion in Dobbs v Jackson Women’s Health Organization was leaked to Politico, I published an article (here) that argued that unless the draft was changed, the final opinion would threaten not just reproductive rights, but a host of substantive due process rights recognized by the Court over the past 70 years.
Non-Prosecution, Deferred Prosecution, and Pretrial Diversion Agreements: Just Say No to Pleas 2022
Deferred prosecution agreements are almost exclusively used in corporate prosecutions, but they are occasionally offered to individuals. Non-prosecution agreements, on the other hand, may be easily obtained for fact witnesses when defense counsel does not want to take the chance that a client is more culpable than originally thought. What are the most critical factors that influence prosecutors to enter into an NPA or a DPA?
